Limitation of Liability | Voltebyk Electric Cycles

Read carefully as this document legally limits your ability to claim damages from Voltebyk.

1. Express Assumption of Risk

Riding an electric cycle involves inherent risks, including but not limited to, the risk of serious injury, paralysis, or death. These risks may result from the rider's own actions, the actions of others, road conditions, weather, or equipment failure. By purchasing, assembling, or riding a Voltebyk electric cycle, the customer expressly and voluntarily assumes all such risks.

2. Limitation of Liability for Personal Injury and Property Damage

To the maximum extent permitted by applicable Indian law, Voltebyk (including its parent companies, subsidiaries, affiliates, directors, officers, employees, agents, and distributors) shall not be held liable for any personal injury, death, property damage, or any other damages arising directly or indirectly from the use, operation, assembly, or maintenance of its products.

This limitation applies whether the claim is based on warranty, contract, tort (including negligence), strict liability, or any other legal theory.

3. Exclusion of Consequential and Incidental Damages

Under no circumstances shall Voltebyk be liable for any special, indirect, incidental, punitive, or consequential damages. This includes, without limitation, loss of income or revenue, loss of use of the product, cost of substitute transportation, medical expenses, or emotional distress.

4. Third-Party Damages

Voltebyk explicitly disclaims all liability for any injuries or damages caused to third parties (pedestrians, other riders, property owners, etc.) while the customer is operating a Voltebyk electric cycle. The customer is solely responsible for obtaining appropriate liability insurance if they deem it necessary.

5. Maximum Liability Cap

In the event that a court of competent jurisdiction finds Voltebyk liable despite these disclaimers, the maximum cumulative liability of Voltebyk for any and all claims arising out of or relating to the product shall be strictly limited to the actual purchase price paid by the customer for the specific product that caused the alleged damage.

6. Indemnification

You agree to indemnify, defend, and hold harmless Voltebyk from and against any claims, lawsuits, demands, or liabilities brought by any third party arising out of your use, misuse, or modification of the Voltebyk electric cycle.
